PhD Disability Scholarships Studentship in Comparative Law and Linguistics

English legal methodology in the 21st century from the perspective of German legal methodology

The PhD will examine English legal methodology and terminology against the comparative background of the German approach. The PhD will start from the premise that the genuinely English approach to legal methodology, both in academia and in practice, has not changed significantly since Gustav Radbruch's research in 1947, despite the continental influence in EU law and the need to adapt to a more continental approach to comply with EU parameters. It will seek to verify or falsify this premise by analysing the writings of academics as well as the case law and legislation to find out whether the traditional approach is still prominent or whether a shift to conceptualisation as a first step to the "elegance of the clear contour" (Radbruch) and ultimately codification is likely to happen anytime soon.

A more detailed description of the topic can be found at: http://www.dur.ac.uk/resources/law/postgraduate/PhDStudentshipincomparativelawandlinguistics.docx
